2. CONDITIONS OF USE

Browsing and using the Platform confers you the status of user of the same and implies your acceptance of every one of the provisions included in this Legal Notice, in force at any time you access the Platform. If you do not agree with these conditions, please stop using the Platform.

This Legal Notice shall apply regardless of any specific conditions TELEFÉRICO may establish for the regulation of certain services and/or content, which, if applicable, must be accepted by the user prior to the provision of the corresponding service, or the General Terms & Conditions that may be applicable.

Users under 14 years old are not allowed to do so. Access to the Refuge, as set out in the General Terms and Conditions, requires being aged 14 or over; therefore, minors aged 14 or over may provide their personal data, but only with the consent of their parents and/or legal guardian

Access to and/or browsing the Platform is free of charge.

If you need to enter personal data in the forms on the website, this data must be truthful, accurate and up to date TELEFÉRICO shall process your data in accordance with the provisions of the Privacy Policy.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY.

Accessing or using the Platform and/or its content or services does not grant you, as a user, any rights over these trademarks, trade names, distinctive signs, or any other elements available on the Platform.

In short, the content and other services are protected by the intellectual or industrial property rights of TELEFÉRICO or third parties, without any rights being transferred to the user. Users are granted only the rights strictly necessary for proper personal use or access to the Platform and its services and content, as provided or that may be provided to the user through the Platform (use that cannot be sublicensed to third parties due to the nature of the service and applicable legal requirements).

  • Using bots, screen scraping, web scraping or any programming tool or other tool that is able to extract and potentially reuse the information or data hosted, stored or accessible on the Platform without the express written authorisation of TELEFÉRICO.

In the event of a breach of these prohibitions, and from the moment TELEFÉRICO becomes aware of such actions, we may warn you to cease such activities, request their immediate removal or correction, or directly delete or block the content. We may also suspend, deactivate or delete your user account, if you have one, without giving rise to any rights or monetary compensation.

5. EXCLUSION OF WARRANTIES AND LIABILITY.

  • TELEFÉRICO does not guarantee the availability and continuity of the operation of the Platform and of the services made available through the same, whether they are its own or those of third parties. Where reasonably possible, we will give prior warning of interruptions to the Platform's operation.
  • TELEFÉRICO does not guarantee that the contents are free from viruses or other elements that may affect your system, although it will take the necessary measures to prevent and correct these issues.

6. APPLICABLE LAW, JURISDICTION.

This Legal Notice is governed in every one of its aspects by Spanish law. Any dispute in relation to this Legal Notice shall be submitted to the Courts and Tribunals of the city of Santa Cruz in Tenerife, unless the applicable regulations establish the jurisdiction of other Courts and Tribunals for these purposes. If, as a user, you are considered a consumer, the applicable jurisdiction shall be that of your domicile.

7. VALIDITY

If any provision of this Legal Notice is declared null and void or invalid, the remaining provisions shall remain valid and binding. Waiver of a stipulation at any individual time does not constitute a waiver of any other stipulation and does not confer any additional rights.

8. MODIFICATION OF THE LEGAL NOTICE
